Service Maintenance

Without prejudice to the other provisions of this Agreement, ResumeCreating shall not be liable for any loss and damage, costs and expense that the Member may suffer or incur, and no fees or charges payable by the Member to ResumeCreating shall be deducted, refunded or rebated, as a result of such deactivation or suspension.

Payment of Dues

ResumeCreating may suspend the Service being provided in the event that any dues payable by the Member are not paid. Upon suspension, the service shall be deemed to be terminated from the date stipulated by ResumeCreating and the Member shall be liable for all charges and fees incurred until that date. Upon subsequent payment by the Member of the requisite payment on demands, ResumeCreating may at its sole discretion and subject to such terms as it deems proper, reconnect the Service.

Member Conduct

• The Member will not allow any other person to use the Service.
• The Member shall use the Service only for the purpose for which it is subscribed.
• The Member will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.
• The Member shall not use the Service(s) for any unlawful purpose including without limitation criminal purposes.

Data Usage

The Member hereby agrees and irrevocably authorizes the Company to:

• Use any data and information supplied by the Member in connection with this Agreement for the Company's own purpose, to the company supplying such data and information to any other associated companies or selected third parties including search engines.
• Use any data furnished by the Member in order to float offers or send mails regarding specific services and such mails may not been proclaimed or deemed to be unsolicited communiqué.
• Allow all data and information supplied by the Member in using the Service to remain at ResumeCreating for the use of the Company in accordance with service agreement with the Member, notwithstanding the termination or suspension of the Service to the Member herein.

Suspension Of Service

In the event the Member has contributed any content to ResumeCreating in any manner whatsoever, the intellectual property of the same shall stand automatically assigned to ResumeCreating and the Member shall have no right or claim over the same. In the event the Member during the term of his agreement or any time thereafter, uses such intellectual property in any other website or related activity, the same can be construed to be an infringement of the intellectual property belonging to www.resumecreating.com and ResumeCreating shall have the right to legal recourse in this regard.

Paid Services

ResumeCreating operates paid services for Resume Writing and Development. By subscribing to receive any of these services, members agree to the following terms:

• The Member will comply with all notices or instructions given by ResumeCreating from time to time in respect of the use of the Service.
• Certain areas of services of ResumeCreating sites are only accessible to users who pay to subscribe.
• Members agree to pay any subscription fees at the rates in effect when the charges are incurred.
• ResumeCreating will start its services only upon realisation of the amount/fee/charges upfront.
• If ResumeCreating does not receive payment authorisation or any authorisation is subsequently cancelled, services may be terminated immediately or access to any paid or unpaid services suspended.
• Members must provide complete and accurate payment information.
• Members can pay by either credit or debit card through their bank’s internet payment gateway. By submitting credit or debit card payment details to ResumeCreating you warrant that you are entitled to purchase the subscription services using those payment details.
• ResumeCreating will charge members in Indian rupees (INR), and any payment in any other currency will be calculated at the relevant rates of exchange along with any applicable local taxes. ResumeCreating will not entertain any dispute about the rate at which currency is converted into Indian Rupees.
• The service would entail providing members, a soft copy of resume from ResumeCreating. Not more than one resume is provided per service request and this does not compulsorily include a covering letter.
• ResumeCreating will try to process all subscriptions promptly but does not guarantee that the paid services will be available to within time specified by the member.
• Delivery period starts from the same time of next working day, after the date on which payment hits the account of ResumeCreating.
• ResumeCreating reserves the rights to reject working on any resume at any stage of the process, if it is noticed that the terms and conditions have not been complied with.
• ResumeCreating would provide the subscribed services only within the time period mentioned on the website for said service and provided that all required information is received on time and are complete as per expectations of ResumeCreating.
• Member can suggest any modifications/alterations to the submitted draft, only once within a period of 7 working days from the date of draft forwarded by ResumeCreating.
• ResumeCreating offers no job guarantee or assurance for the resume developed. The service would only help in getting a resume crafted in a powerful way and as per the market trends.
• All outstanding balances must be cleared and must be paid in full in order to avail the complete services of the services subscribed/registered for.
• There will be separate charges for re-writing the resume again, if required to suit a different job profile other than the one availed for and once the validity period is expired.
• ResumeCreating reserves its right to reject / modify any insertion or information/data provided by the user without assigning any reason.
• ResumeCreating would not be held liable for any loss of data technical or otherwise, information, particulars supplied by the individual due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.

Refund Policy

Refund requests will be processed and managed on case to case basis and the decision to refund will be made in the absolute discretion of ResumeCreating.

• If agreed by ResumeCreating, refund will be processed and will be credited back to the original credit/debit card or bank account as per the timeframe of respective Bank which is usually between 75 days (for VISA/MASTER) and 120 days (for AMEX) as per their rules. ResumeCreating does not have any control on the processing or timelines prescribed by the bank and is not responsible for any such issues.
• ResumeCreating will not refund the payment/charges for services delivered in partial or full such as after delivery of drafts, modifications, rectifications done as per member feedback.
• Incase any member defames ResumeCreating on public forum / blogs / public domains & websites / Social Media sites, same will be considered as acting against ResumeCreating and hence the member / client order ID will be blocked in the system with immediate effect and no further request of any sort/value will further ever be entertained by ResumeCreating till he / she removes the post. ResumeCreating will also have the right to take a legal action / file a case against such people / clients participating in such activities.

Legal Jurisdiction

This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the ResumeCreating service, contains the entire agreement between You(“Member”) and ResumeCreating regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. These terms and conditions shall be governed by, and construed in accordance with laws of the Government of India. Users of ResumeCreating websites also explicitly agree that only courts in India shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of Indian courts.
